Welcome to TrafficmarkePlace, Inc.'s (hereinafter "TMP", "we", or "us") website. This privacy policy discloses our privacy practices for TMP Network members.
TMP owns the information collected on this site. We collect two distinct categories of information: Member information and aggregated web user information. This portion of TMP's privacy policy applies only to Members of TMP (an advertiser or publisher partner who has registered to do business with TMP). INFORMATION WE COLLECT?

Personally Identifiable Information
Members of the TMP Network include publishers and advertisers involved in advertising transactions through TMP Social and Traffic Marketplace. To access certain websites operated by TMP, we may ask you to register and provide certain personally identifiable information or "PII" that is necessary to conduct business, such as name, phone number, email address, social security number, and/or tax ID number. Payments made to and from TMP require the provision of and certain collection of personally identifiable information that may include bank account information and credit card numbers. Phone numbers may be used to contact Members for business development, sales, or inventory acquisition purposes. All Member information is collected, modified (as needed) and stored in a password protected environment. This information is used for service, media delivery, contact, billing and accounts payable purposes. We will not sell, share (except as provided for herein), or rent this information to non-TMP entities. All Member information collection is explicit, voluntary, and manually entered by the Member.
Non-Personally Identifiable Information
Traffic Marketplace also automatically receives and records anonymous information that your browser sends whenever you visit a website which is part of the Traffic Marketplace Network. We use log files to collect Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, one or more cookies that may uniquely identify your browser, and responses by a web surfer to an advertisement delivered by us. This information may be stored on our systems for about one year.
Traffic Marketplace uses technology, including technology from its third party advertising vendors, which includes cookies, "web beacons" and/or "action tags." "Cookies" are files (e.g. flash browser objects or http header) that are stored on your web-enabled client (such as your web browser). A "web beacon" or "action tag" is a small image (usually 1x1 pixel) embedded in a web page or email. We use cookies, web beacons and action tags to collect non-personally identifiable data to provide better and more relevant services and messages to that user. Cookies, web beacons and action tags permit us to recognize users and avoid repetitive requests for the same information. As a rule, non-personally identifiable information is anonymous and is not used to identify a specific person by Traffic Marketplace.

 

HOW IS SUCH INFORMATION USED?

Personally identifiable information
Member information is used only for purposes of administering our relationship with Members and is not shared with any third party outside TMP and its affiliated companies, except as expressly provided for herein, or with your consent, or as necessary to comply with the law. We use such information to conduct business, such as to process a credit card transaction for an advertising campaign purchase or making an ACH direct deposit to pay a Publisher. TMP may provide email address and basic account data to an Advertiser or Publisher to facilitate a potential or continued working relationship between the Advertiser and Publisher or for compliance matters. Once an affiliation is established, Advertiser and Publisher (or their agents or other third parties as designated by a Member) are privy to their respective campaign information and PII, including anonymous Internet user transaction data for Internet users referred by Publisher and any other information that a Member may instruct TMP to disclose.
Our Member email list is used for administrative and business purposes only. We may send emails welcoming new Members or to announce service announcements, special offers and promotions. Members are not able to un-subscribe from service announcements because they contain important information about our services and we may contact Members relating to business issues via email or phone. If a Member's personally identifiable information changes (such as his/her email address), the Member should correct and update his/her information in the TMP Member area.
Non-personally identifiable information
Traffic Marketplace may use your non-personal information in order to better target advertisements across the Traffic Marketplace Network, to provide aggregate reporting to Members, and to improve our advertising systems and products. We use the information to analyze site usage, administer the site, understand usage and navigation trends in aggregate, and determine the relevance of content. We may also share non-personally identifiable information with our subsidiaries and third party partners for similar use.
In the event that TMP is acquired by or merged with a third party entity, we reserve the right, in any of these circumstances, to transfer or assign the information we have collected from you as part of such merger, acquisition, sale, or other change of control. In the unlikely event of our bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your information is treated, transferred, or used.

This website may contain links to other parties' websites. Please be aware that TMP is not responsible for the privacy practices of such other websites. We encourage our users to be aware when they leave our website and to read the privacy policies of each and every website that collects personally identifiable information. This privacy policy applies solely to information collected by this website.

 

Security

TMP employs commercially reasonable security measures to ensure the security of all data. In addition, we comply with all applicable data security laws. No system is guaranteed to be completely secure and it may be possible for third parties not under the control of TMP to intercept or access transmissions or private communications unlawfully. While we strive to protect your PII, TMP cannot ensure or warrant the security of any information you transmit to us. You acknowledge and assume this risk when communicating with a TMP Network company. In the event of a breach we will comply with all applicable notification requirements required under the law.

 

INTERNATIONAL TRANSFERS AND SAFE HARBOR

Traffic Marketplace adheres to the Safe Harbor Agreement concerning the transfer of personal data from the European Union to the United States. In order to comply with the European Union's Safe Harbor principles, we commit to resolve any complaints by European Union citizens relating to this policy, which cannot be resolved directly with our company, through the Council of Better Business Bureaus, Inc.'s Safe Harbor Privacy Dispute Resolution Procedure. By providing information to us, you acknowledge that we operate in the United States and agree to (i) permit us to transmit and use your information anywhere necessary, including across international boundaries, to effect the services and transactions provided by this Site; and (ii) that such use by us shall be subject to the terms and conditions stated in this Privacy Policy and applicable Terms and Conditions and Policies.
